@tzubear: I didn’t see anything that indicated it was consensual. I don’t think a 13 year old could consent in any event. It varies from state to state and I don’t know New Mexico, but I’m guessing it’s not second degree because he didn’t use a weapon or there was no great bodily harm (well aside from the rape).

Exactly, it is statutory rape even if he didnt force himself on her. I cant imagine she was down with sodomy?! So, if he did force himself on her, I am confused what he would have had to do for 1st degree rape. I suppose the bodily harm angle is the reason, but it seems this would just add an assault/battery charge on top of rape.

tzubear: I just looked up the statutes in New Mexico (well a summary of them) linked in my name. It’s the great bodily harm that is the distinction, or if the victim is under 13. I guess this all presumes that this took place in New Mexico, which is not clear from the article.
